Solar Credits - transitional arrangements for 4x multiplier
How to access the 4x Solar Credits multiplier under the Renewable Energy (Electricity) Amendment Regulations 2011 (No 3).
Is my system eligible?
Your system may be eligible for the 4x multiplier if it meets ALL of the following criteria.
- The unit must be eligible for Solar Credits.
- The unit must be installed between 1 July 2011 and 30 June 2012.
- The unit must be installed under a contract entered into before 5 May 2011.
- The parties to the contract must be legally bound to proceed with the contract.
- If the contract is conditional on any event happening, that event happened before 5 May 2011.
- The person who becomes the owner of the system following its installation must be a party to the contract.
- The Registered Person/Agent creating the certificates must possess the contract documentation confirming:
- the date the contract was entered into;
- the identity of each party to the contract;
- the address at which the unit was installed; and
- the size, make and model of the system.
- If the contract was made as an oral contract before 5 May 2011, written documentation must have been created and dated on or before 9 June 2011, evidencing the existence of the contract.
The Registered Person/Agent creating the certificates must be able to complete and sign a Statutory Declaration which confirms the above information and states that the person is able to supply the specified documentation to ORER on request.
- ORER has provided sample Statutory Declarations which contain all the information that is required.
- The Statutory Declaration must be in the possession of the Agent/creator of the certificates prior to the creation of certificates.
If your system does not meet all of the above requirements, it may still be eligible for the 3x solar credits multiplier. Please see the main Solar Credits eligibility page for more information.
Definition of contract documentation
For the purposes of the 4x solar credits multiplier, "contract documentation" means:
- for a written contract - the written documents setting out the terms and conditions of the contract and evidencing the offer and acceptance of those terms and conditions.
- for an oral contract - written documentation that was created and dated on or before 9 June 2011, evidencing the existence of the contract.
Requirements for Statutory Declaration for a written contract (basic rule)
The sample Statutory Declarations outline all the information that is required.
The statutory declaration must be completed and signed by the person creating the certificates (Registered Person or Registered Agent) and must contain the following:
- A Statement that the person possesses a copy of the written contract, as defined under “Eligibility”.
- Verification that the parties to the contract were legally bound to proceed with the contract.
- Verification that if the contract was conditional on any event happening, the event occurred before 5 May 2011.
- Verification that the owner of the system is a party to the contract.
- A Description of the contract documentation (particularly if it is contained in multiple documents, such as emails and signed papers).
- Provision of the following information from the contract documentation:
- Date contract was signed
- Names, address, and contact details of all parties to the contract
- Address at which system was installed
- Size, make and model of the installed unit
- Certification that this information comes from the contract.
- Certification that the person can provide copies of the contract documentation at the request of the Clean Energy Regulator.
Note that the contract documentation itself does not need to be supplied to the Clean Energy Regulator unless it is requested.
When completed, the signed document must be supplied to the Clean Energy Regulator. It is suggested that you first create the certificates in the REC Registry, then immediately send the statutory declaration documents as follows:
- Email to retstatdec@cleanenergyregulator.gov.au
- Place your REC Registry account name (exactly as it appears in the REC Registry) and the Accreditation Code and/or Bulk Upload I.D relating to the Statutory Declarations into the "subject" field.

Requirements for Statutory Declaration for oral documentation (supplementary rule)
The sample Statutory Declarations outline all the information that is required.
The person creating the certificates must complete and sign a Statutory Declaration as outlined in the basic rule above.
IN ADDITION, Statutory Declarations must be completed, signed, and supplied to the Registered Person/Agent by each and every party to the contract.
The additional statutory declarations must contain the following:
- Statement that a legally binding contract was entered into before 5 May 2011.
- Certification of the following information:
- Names, address, and contact details of all parties to the contract;
- Form in which the legally binding contract was entered into (for eg, it may have been a written contract with a verbal acceptance);
- Date on which the legally binding contract was entered into;
- Address at which system was installed; and
- Size, make and model of the installed unit.
ORER may request any other information or documentation that it may require to ensure it can verify information provided in the statutory declarations.
When completed, the signed document must be supplied to ORER by the Registered Person/Agent creating the certificates. It is suggested that you first create the certificates in the REC Registry, then immediately send the statutory declaration documents as follows:
- Email to retstatdec@cleanenergyregulator.gov.au.
- Place your REC Registry account name (exactly as it appears in the REC Registry) and the Accreditation Code and/or Bulk Upload I.D relating to the Statutory Declarations into the "subject" field.

Multiple contracts
If a registered person/agent has multiple written contracts, they may provide one statutory declaration for those multiple contracts, as long as all the required information for those contracts is contained in that single statutory declaration.
Multiple oral (verbal) contracts will require separate statutory declarations. If the registered person/agent is a party to the verbal contract then they only need to provide a second statutory declaration from the other party to the contract.
How to create certificates for the 4x multiplier
- Ensure the Registered Person/Agent is in possession of all the contractual documentation and the statutory declaration BEFORE starting certificate creation.
- Answer “Y” to the question: "Do you meet the transitional requirements for receiving the 4x multiplier?"
- Immediately email the required documents to retstatdec@cleanenergyregulator.gov.au.
Failure to comply with the above requirements may lead to a delay in your certificates being assessed by the Clean Energy Regulator.
