Emissions-Intensive Trade-Exposed
The Large-scale Renewable Energy Target (LRET) and Small-scale Renewable Energy Scheme (SRES) legislation and regulations include provisions to provide partial exemptions from LRET and SRES liability for electricity used in defined emissions-intensive trade-exposed (EITE) activities. Prescribed persons (typically entities that carry on these EITE activities) may apply for a partial exemption certificate (PEC).
From 2 April 2012 the Clean Energy Regulator will administer both the Renewable Energy Target and the Carbon Pricing Mechanism, including the allocation of free carbon units and PECs in respect of EITE activities.

Requirements for RET liable entities
To receive the exemption, the RET liable entity named on the partial exemption certificate (PEC) must obtain a copy from the person issued with the PEC and provide this copy to the Renewable Energy Regulator as part of its annual energy acquisition statement (AEAS) and annual renewable shortfall statement in February following the year mentioned on the PEC. If this transaction occurs then additional information is published relating to RET liable entities that report PECs in this AEAS.

The Clean Energy Regulator recommends that potential prescribed persons make themselves familiar with the legislation and if necessary seek their own legal advice prior to making an application for a partial exemption certificate (PEC).
