RET Liable Entities that received a partial exemption for 2010

Under the Renewable Energy (Electricity) Act 2000 (the Act) and Renewable Energy (Electricity) Regulations 2001 (the Regulations), companies conducting emission intensive trade exposed (EITE) activities can apply to the Clean Energy Regulator for partial exemption certificates (PECs).

An EITE company that meets the eligibility criteria is issued with a PEC. The EITE company can then negotiate the transfer of the PEC to the RET liable entity. The RET liable entity can then use the PEC to reduce their annual relevant acquisitions of electricity thereby reducing their annual STC and LGC liability. The small-scale technology certificate (STC) liability started in 2011, for 2010 there was no STC liability.

In accordance with section 38C of the Act and Regulation 22E (1), the following information must be published on the Clean Energy Regulator website before 1 October in the following year:

  • the name of each RET liable entity
  • the value in dollars estimated by the Regulator of the amount of partial exemption for the year. $37.12 is estimated by the Regulator to be the volume weighted average price of LGCs in 2010 and has been used for this purpose.
  • each EITE activity set out in the PECs to which the partial exemption relates to.

The table below provides:

  • a List of RET liable entities and the dollar value of the amount of each entity’s partial exemption for 2010. The dollar value of partial exemptions is calculated by multiplying PEC MWh with the 2010 RPP and then multiplied by $37.12.
  • the name of each of the emissions-intensive trade-exposed activities set out in the partial exemption certificates to which the partial exemption relates.
